Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the website mortgageeasy.co.nz (the "Site") operated by Build Reach Limited (NZBN 9429053438355), trading as Mortgage Easy ("we", "us", "our"). By using the Site or submitting an enquiry, you agree to these Terms. If you do not agree, please do not use the Site.

1. No financial advice

Mortgage Easy is a marketing service that introduces consumers to licensed New Zealand mortgage advisers. Nothing on this Site, in any advertising, or in any communication from us constitutes financial advice, a recommendation, or an offer of credit. We are not a registered bank, non-bank deposit taker, or Financial Advice Provider.

All information on the Site (including indicative interest rates, cashback amounts, savings estimates and eligibility messages) is general information only and may not reflect current market conditions or your personal circumstances. You must obtain personalised advice from a licensed Financial Advice Provider before making any decision about a mortgage.

2. Introduction to a licensed adviser

When you submit the form, we share your enquiry with one or more licensed mortgage advisers registered on the Financial Service Provider Register (FSPR) and regulated by the Financial Markets Authority. The adviser will contact you to discuss your situation, provide their Disclosure Statement and FSP number, and (if you choose to proceed) act as your adviser. Once an adviser engages with you, your relationship is with that adviser. We are not a party to, and accept no responsibility for, the advice or services provided by the adviser.

3. Eligibility

To use the Site and submit an enquiry you must:

  • Be at least 18 years old;
  • Be a New Zealand resident or citizen;
  • Provide accurate, complete and current information;
  • Only submit your own details, or details you are authorised to submit.

4. Indicative figures and cashback

Any savings, monthly payment reductions, or cashback figures shown on the Site (including in illustrative activity notifications, testimonials or hero copy) are illustrative examples or historical figures only. Actual outcomes depend on your loan size, lender policy, credit assessment, property valuation, fixed-term arrangements and current market conditions.

Cashback offers are made by the relevant lender, not by us. Cashback amounts vary and are subject to the lender's terms, including potential clawback if you repay or refinance the loan within the lender's specified period (typically 3-4 years).

5. Consent to contact

By submitting the form you consent to being contacted by phone, SMS and email by a licensed Financial Advice Provider and, where applicable, by Mortgage Easy, about your enquiry. You can withdraw this consent at any time by telling the adviser, or by emailing hello@mortgageeasy.co.nz.

6. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in breach of any New Zealand law;
  • Submit false, misleading or another person's details without authorisation;
  • Interfere with, attempt to gain unauthorised access to, or disrupt the Site;
  • Scrape, copy, reproduce or republish content from the Site without our written consent.

7. Intellectual property

All content on the Site (including text, design, graphics and the Mortgage Easy name and logo) is owned by or licensed to Build Reach Limited and is protected by New Zealand and international intellectual property laws. You may view and print pages for your personal, non-commercial use.

8. Third-party links and brands

The Site may reference third-party brands (including New Zealand banks). Those brands and trademarks are the property of their respective owners. References do not imply any endorsement of Mortgage Easy by, or affiliation with, those parties.

This Site is not part of Facebook, Instagram, or Meta Inc. and is not endorsed by Meta in any way. FACEBOOK and INSTAGRAM are trademarks of Meta Platforms, Inc.

9. Disclaimer and limitation of liability

The Site is provided "as is" and we make no warranties about the accuracy, completeness, or availability of the Site or any information on it. To the maximum extent permitted by law:

  • We exclude all implied warranties, conditions and guarantees;
  • We are not liable for any loss, damage or cost (including any indirect, consequential or economic loss) arising from your use of the Site or from any advice or services provided by an adviser we introduce you to;
  • Our total aggregate liability to you under or in connection with these Terms is limited to NZD $100.

If you are acquiring our services for the purposes of a business, you agree the Consumer Guarantees Act 1993 does not apply.

10. Complaints

If you have a complaint about the Site or our marketing, please email hello@mortgageeasy.co.nzand we will investigate. Complaints about advice or services should be made directly to the licensed adviser and, if not resolved, to their disputes resolution scheme (which they will provide details of in their Disclosure Statement).

11. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

12. Changes

We may update these Terms at any time. The "Last updated" date at the top shows when the Terms were last changed. Continued use of the Site after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by New Zealand law. You and we submit to the non-exclusive jurisdiction of the New Zealand courts.
